This website is owned and operated by The Brocante de Baupte. These Terms set forth the terms and conditions under which you may use our website and services as offered by us The Brocante de Baupte. This website offers visitors the opportunity to view and purchase genuine antique, vintage and collectable articles. By accessing or using the website and our service, you approve that you have read, understood, and agree to be bound by these Terms.
Who can use this website and what are the requirements to create an account

In order to use our website and/or receive our services, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.
Key commercial Terms offered to customers

When buying an item, you agree that:

You are responsible for reading the full item listing/description and viewing all and or any photographs before making a commitment to buy it

You enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process. The prices we charge for using our services / for our products are listed on the website, all transactions are in Euros.

We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. Once an item has been purchased, the price listed is the final price paid by the buyer. All prices are inclusive of any processing fees but not freight and or shipping costs.

Any additional information about the services and any other charges you may incur in connection with your use of the service, such as shipping costs etc; will be listed and available on the payments/checkout page.

Any and all items ordered/purchased on the site remain the property of The Brocante de Baupte up until the final and full payment is made, in accordance with the terms of Law No. 80 335 of 12 May 1980

The Brocante de Baupte is registered as a Micro-Entrepreneur and as such, is not subject to VAT, in accordance with Article 293B of the CGI. The declaration 'VAT not applicable, art. 293 B of the CGI, will be stated on all invoicing.
Customs and import taxes

The purchasers/buyers are solely responsible for any incurred customs, import and or country/state taxes that may apply or be charged either at time of purchase or during transit and shipping. Such fees/taxes that are charged by the Country/Government concerned are not the responsibility of The Brocante de Baupte.
Customs and import delays
​
The Brocante de Baupte is not responsible for any delays during shipping, or due to customs, or to the delay in requesting and paying any import duties at customs.
However, for any delays, or issues with the shipping of any purchases, please contact us at brocantedebaupte@outlook.com and we will do our best to help expedite the shipping.
Return and refund policy
All communications with regards to any returns will be made with brocantedebaupte@outlook.com
The Brocante de Baupte offers a 14-day return policy subject to the request and justification to return an item/items being made within 14 days of receiving it. Any items returned must be returned in the same condition in which it was shipped and received, with no signs of use or damage, and shipped in its original packaging. All receipts and/or proofs of purchase will be required.
Only the item cost will be refunded, no shipping costs, or return shipping costs will be refunded.
For any items being shipped into the European Union, you have the right to cancel or return your order within 14 days, for any reason and without justification. Any item returned must be in the same condition in which it was shipped and received with no use or damage, and shipped in its original packaging. All receipts and/or proofs of purchase will be required.
When a return request is agreed and accepted, The Brocante de Baupte will advise all requirements on how and where to return your package.
Note; Any items sent back to us without first requesting and agreeing a return will not be accepted.
Damage in Transit
Should your item arrive damaged, or should you believe that due to damage to the packaging the there is a risk of damage to the item itself, you should immediately advise the courier/delivery person, and take photographs of the damage. Advise us at brocantedebaupte@outlook.com immediately so that we can evaluate the issue and start to advise any actions required.
Exchanges
The Brocante de Baupte does not offer exchanges.

Cancellations
​
The Brocante de Baupte does not offer any cancellations after dispatch and shipment of the item has been undertaken, if you wish to cancel your order you must contact us immediately at brocantedebaupte@outlook.com before the order has been processed and dispatched.

Refunds
Refunds will only be made once we have received and inspected the returned item. If approved, you will be automatically refunded for the amount of the item only using your original payment method within 10 business days.
Retention of right to change offering
​
We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.
Warranties & responsibility for services and products

All of the products/items offered for sale by The Brocante de Baupte on this website are listed and offered as ‘genuine and original antique, vintage and collectable articles’.
All the items are sold in a used, original condition.
Therefore, the Brocante de Baupte offers no warranties, guarantees, exchanges, repairs or servicing of any of its items and as such;

You the buyer are responsible for reading the full item listing/description including all and any advisory notes and item condition notes and viewing all and or any photographs before making a commitment to buy it.

Where required, any installation and or operation of the items should be undertaken and certified by, and in association with, a qualified contractor.
Ownership of intellectual property, copyrights and logos

The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of WIX and The Brocante de Baupte. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.
Should it be agreed, you recognize and agree that by uploading any content (including, but not limited to designs, images, animations, videos, audio files, fonts, logos, illustrations, compositions, artworks, interfaces, text and literary works) through any means to the website, you confirm that you own all the relevant rights or received the appropriate license to upload/transfer/send the content. You agree and consent that the uploaded/transferred content may be publicly displayed at the website.
Right to suspend or cancel user account

We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment
Indemnification
